IMPORTANT INFORMATION

Participants and parent/guardians of minor registering for this activity must recognize that there is an inherent risk of injury when choosing to participate in this boating event. You are solely responsible for determining if you or your minor/ward are physically fit and/or skilled for the activities contemplated by this agreement.

WARNING OF RISK

This competition is intended to challenge and engage the physical, mental and emotional resources of each participant. Despite careful and proper preparation and instruction there is always risk of serious injury. Understandably, not all hazards and dangers can be foreseen. Depending on the particular activity, participants must understand that certain risks, dangers, and injuries due to inclement weather, slipping, falling, poor skill level or conditioning, carelessness, horseplay, unsportsmanlike conduct, premises defect, inadequate or defective equipment, inadequate supervision, instruction or officiating, and all other circumstances inherent to indoor and outdoor recreational activities exist. In this regard, it must be recognized that it is impossible for the the Chicago Park District, Westrec SMI, The Italian American Human Relations Foundation, the Chicago Yachting Association, and the Chicago Yacht Club to guarantee absolute safety.

WAIVER AND RELEASE OF ALL CLAIMS
AND ASSUMPTION OF RISK

Please read this form carefully and be aware that in signing up and in participating in this activity, you will be expressly assuming the risk and legal liability and waiving all claims for injuries, damages or loss which you or your minor child/ward might sustain as a result of participating in any and all activities connected with and associated with this activity. This waiver and release of all claims and assumption of risk includes any damage that participating vessels might sustain as a result of participating in any and all activities connected with and associated with this activity.

“I recognize and acknowledge that there are certain risks of physical injury to participants in this activity, and I voluntarily agree to assume the full risk of any and all injuries, damages or loss, regardless of severity, that my minor child/ward or I may sustain as a result of said participation. I further agree to waive and relinquish all right of recovery, claim action or cause to action against the Chicago Park District, Westrec  SMI, The Italian American Human Relations Foundation, and the Chicago Yachting Association, Chicago Yacht Club, including their officials, agents, volunteers and employees (the “Released and Indemnified Parties”) that I or my minor child/ward may have or accrue as a result of participating in this activity and to indemnify and hold harmless the Released and Indemnified Parties for any such injuries, claims or damages that I or my minor child/ward may incur or assert.

I do hereby agree to fully indemnify, release and forever discharge the Released and Indemnified Parties from any claims for injuries, damages, or loss that my minor child/ward or I may have or which may accrue to me or my minor child/ward and arising out of, connected with or in any way associated with this activity.

I have read and fully understand the above important information, warning of risk, assumption of risk and waiver and release of all claims.”

PHOTO RELEASE

“I hereby give my consent for photographs to be taken of my minor child/ward or me and, without limitation, to use such photographs without consideration of any kind. I do hereby release discharge he Chicago Park District, Westrec SMI, The Italian American Human Relations Foundation, the Chicago Yachting Association, and the Chicago Yacht Club including their officials, agents, volunteers and employees that I or my minor child/ward may have from any claims whatsoever which may arise in said regard.”

MEDICAL RELEASE

“In the event of an emergency, I authorize the he Chicago Park District, Westrec SMI, The Italian American Human Relations Foundation, the Chicago Yachting Association , and the Chicago Yacth Club to secure from any licensed hospital, physician, and/or medical personnel any treatment deemed necessary for my immediate care, or that of my minor child/ward, and agree that I will be responsible for payment of any and all medical services rendered.”
